1. GENERAL PROVISIONS

3. SERVICE DESCRIPTION
- 3.1 Prime Sushi Take Away offers an online ordering system where customers can order sushi and other dishes for pickup or delivery.
- 3.2. We strive to provide accurate menu descriptions and prices, but availability is subject to change. We reserve the right to change or update our menu, prices, and opening hours without prior notice.
- 3.3. Images on the website are for illustrative purposes only. Actual products may vary slightly.
4. ORDERING PROCESS
- 4.1. An order is placed through the website or mobile app by selecting products and proceeding to checkout.
- 4.2. Please verify the accuracy of your order details (items, quantity, address, contact information) before confirming. Incorrect details may result in delays or cancellation.
- 4.3. After placing your order, you will receive an automatic confirmation via email or SMS. This confirms receipt of your order but does not guarantee its acceptance.
- 4.4. An order is considered accepted when you receive a separate confirmation that it is being prepared or sent for delivery.
5. PRICES AND PAYMENT
- 5.1 All prices are in Euros (EUR) and include VAT.
- 5.2. Payment can be made online (by bank card, Apple Pay, PayPal, and other available methods) or upon pickup, depending on the option selected.
- 5.3. Payments are processed by secure third-party payment systems. Prime Sushi Take Away does not store your payment data.
- 5.4 In the event of technical or pricing errors, we reserve the right to cancel or adjust your order by notifying you.
6. DELIVERY AND PICKUP
- 6.1. Delivery: Available within designated areas of Tallinn. Delivery costs and estimated delivery times are displayed during checkout.
- 6.2. Pick-up: You can pick up your order from the restaurant at the specified time.
- 6.3. We strive to deliver orders on time, but delays may occur due to traffic conditions, weather, or other circumstances.
- 6.4 If the customer is not at the delivery address or does not pick up the order on time, it may be cancelled without a refund.
7. CANCELLATION AND REFUND
- 7.1 Once the order has been confirmed and preparation has begun, cancellation is not possible.

- or by phone (if indicated on the website).
7.3. Refunds are only possible in the following cases:
- The order was not completed due to our error or due to the absence of goods.
- The order was cancelled before preparation began.
- You received an incorrect or damaged item and reported it within 24 hours.
- 7.4 Refunds are made using the same payment method within 5-10 business days.
- 7.5 We may refuse a refund if there is evidence that the order has been delivered and accepted.
8. CLIENT'S RESPONSIBILITIES
- 8.1 You must provide accurate contact, address and payment information.
- 8.2. You must ensure the presence of the recipient at the delivery address.
- 8.3. You undertake not to abuse the online ordering system or interfere with the operation of the website.
9. PROTECTION OF PERSONAL DATA
- 9.1 We collect and process personal data in accordance with our Privacy Policy, which is published on the website.
- 9.2. The data is used only for order processing, customer support and (with your consent) marketing communications.
- 9.3 By placing an order, you agree to the use of your data to contact you.
10. ALLERGENS AND PRODUCT INFORMATION
- 10.1 Our dishes may contain allergens: fish, seafood, soy, gluten, sesame, eggs, nuts.
- 10.2 Customers with allergies or dietary restrictions must notify us before placing an order.
- 10.3. Prime Sushi Take Away is not responsible for allergic reactions unless the customer has notified them of the allergy in advance.
11. LIMITATION OF LIABILITY
11.1 To the extent permitted by law, Prime Sushi Take Away is not responsible for:
- Indirect or consequential damages;
- Losses due to delays, force majeure or failure of third-party services;
- Minor differences in appearance or portion size.
11.2 These Terms do not limit liability for intent or gross negligence.
12. INTELLECTUAL PROPERTY
- 12.1. All materials on the website (texts, logos, images, design) belong to Prime Sushi Take Away and are protected by copyright.
- 12.2. Copying and distribution without written permission is prohibited.
13. APPLICABLE LAW AND DISPUTE RESOLUTION
- 13.1 These Terms are governed by the laws of the Republic of Estonia.
- 13.2. Disputes are resolved through negotiations, and if this is not possible, in the Harju County Court.

14. CHANGES TO TERMS
